What this covers
These terms govern your use of the telosbrain.com website. They do not govern use of the Telos Brain product — that is covered by the Telos Brain Terms of Use, which you accept when you create an account or install the software.
1. Who we are
1.1 This website is operated by Telos Limited (incorporated in New Zealand, company number 9429052358715) for the Telos group of companies ("Telos", "we", "us", "our").
1.1A Telos Brain is contracted with Telos NZ Limited (NZBN 9429052360978, company number 9277658), Level 4, 40 Taranaki Street, Wellington, New Zealand — not with Telos Limited. Creating an account or installing the software forms a contract with Telos NZ Limited under the Telos Brain Terms of Use.
1.2 By using this website you agree to these terms. If you do not agree to them, do not use the website.
2. Relationship to the product terms
2.1 Telos Brain is governed by the Telos Brain Terms of Use and the documents it incorporates, available at https://trust.telosready.com. Your contracting party under those terms is Telos NZ Limited.
2.2 If there is any inconsistency between these website terms and the Telos Brain Terms of Use, the Telos Brain Terms of Use prevail in relation to the product.
2.3 Creating an account, generating an API key, or installing the Telos Brain software is governed by the Telos Brain Terms of Use, not by these website terms.
3. Using this website
3.1 You may view, download and print material from this website for your own information and internal business purposes.
3.2 You must not:
- copy, republish or redistribute material from this website for commercial purposes without our prior written consent;
- scrape, crawl, harvest or systematically extract content from this website, including for the purpose of training, fine-tuning or evaluating any machine learning model;
- use this website in a way that damages, disables, overburdens or impairs it, or interferes with any other person's use of it;
- attempt to gain unauthorised access to any part of this website or any system or network connected to it;
- introduce any virus, malicious code or harmful component; or
- remove, obscure or alter any proprietary notice.
3.3 Clause 3.2(b) does not restrict ordinary indexing by a search engine that respects our robots.txt file.
4. Intellectual property
4.1 All intellectual property rights in this website and its content — including text, graphics, logos, layout, and the Telos and Telos Brain names and marks — are owned by or licensed to us.
4.2 Nothing on this website grants you any licence or right to use any trade mark, logo or brand appearing on it.
4.3 Code samples and command line examples shown on this website may be copied and used freely. Software you obtain from us, including any package published to a package registry, is licensed under the terms accompanying it and, where applicable, under the Telos Brain Terms of Use.
5. Information on this website
5.1 The content of this website is provided for general information. It is not advice, and you should not rely on it as the sole basis for any decision.
5.2 We take reasonable care with the content of this website, but we do not warrant that it is accurate, complete or current. Product descriptions, feature lists, roadmaps and performance claims describe our intentions and current understanding, and may change without notice.
5.3 Nothing on this website forms part of any contract between us unless it is expressly incorporated into the Telos Brain Terms of Use.
5.4 Pricing shown on this website is indicative. The rates that apply to you are those in the Rate Schedule referred to in the Telos Brain Terms of Use.

6.2 You may link to this website provided you do so fairly, do not suggest any association or endorsement that does not exist, and do not frame or misrepresent our content.

7.1 We handle personal information in accordance with the Telos Brain Privacy Policy.
7.2 This website uses cookies and similar technologies. Section 11 of the Privacy Policy explains how, and you can manage your preferences using the controls we provide.

8.1 To the maximum extent permitted by law, this website and its content are provided "as is" and we exclude all warranties, conditions and representations, whether express, implied or statutory.
8.2 To the maximum extent permitted by law, we are not liable for any loss arising from your use of, or inability to use, this website, or from your reliance on its content, including any indirect or consequential loss.
8.3 Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified. Where you use this website for the purposes of a business, the Consumer Guarantees Act 1993 does not apply.

9.1 We may change these terms at any time by publishing an updated version on this website. The version in force is the one published when you use the website.

9.3 These terms are governed by New Zealand law, and the parties submit to the non-exclusive jurisdiction of the New Zealand courts.
